Q: I researched your site and could not come up with a suitable answer to my question. If a firm located in Italy with several hundred employees has only 5 employees in the U-S, are those 5 covered under COBRA? U-S subsidiary has their own tax ID number but is solely owned by Italian firm.

A: If the US subsidiary has less than 20 employees, they are not subject to federal COBRA and do not have to offer you continuation of their group benefits. If you have pre-existing conditions or need on going medical care, you maybe eligible for a mini-COBRA.  You can visit www.naic.org  to see if your state has a Mini-COBRA continuation plan.  If you are a healthy person and would be interested in a lower cost Alternative to COBRA please Click Here
