Q:How can I get reinstated? The late payment was no fault of mine. I am currently using Wageworks to cover my insurance premium and they sent the check back because of the different amount. By the time I received notice that they would not pay and paid myself, it was too late. I have been making timely payments since that time and suddenly I received a cancellation letter dated January, 2008. Wageworks assures that my payments will be made on time for the current amount.
A: Your COBRA plan administrator must give you a 30 day grace period to make a late payment. If your payment is received after the grace period has expired, the plan administrator does not have to accept your late payment. You should contact your previous employer or COBRA plan administrator to see if they will reinstate your COBRA continuation. If you were not give a 30 day grace period, then you should contact the US Department of Labor at 1-866-487-2365 to file a complaint. If you are a healthy person and would be interested in a lower cost Alternative to COBRA please Click Here
