Q: I have a nephew who graduated high school in June 2007 and is being carried on his father's insurance (COBRA). He recently enrolled in an on-line college program with a nationally accredited (but not regionally accredited) on-line college. He is taking 6 credit hours of courses. Does this qualify him for COBRA coverage past December 2008? If not, what factors make him ineligible? Are there a minimum number of credit hours to qualify? Does the lack of regional accreditation matter? Your response is appreciated.
A: The amount of time a beneficiary can remain on COBRA will depend on the qualifying event. If the dependent child’s benefits ended because his father lost his job, the dependent child is allowed a maximum of 18 months. As far as COBRA continuation coverage, it doesn’t matter if he is in school or not. If your nephew is a dependent on his father’s insurance plan it may have requirements (i.e.: age, number of credits a student must take) to continue as a dependent on the group insurance policy.
There are some situations that may allow the beneficiary to keep COBRA longer. If they become disabled during the first 60 days of COBRA continuation coverage they may be eligible for an 11 month extension. If the covered employee dies or there is a divorce the spouse and dependent child are allowed a maximum of 36 months. Also, if the dependent child loses his dependent child status he could be eligible for 36 months.
