Q:  We are getting ready to terminate an employee that has been with the company for a little over a year. Our company has 6 full time employees and 3 on contract labor. We have group medical insurance.  Are we required by law to offer the COBRA insurance?  Can we supply it as a courtesy?  I Is there a particular form I can supply to them, telephone #, or just send them to this website? Thank you

 

A:  COBRA is the name of a federal law. COBRA contains provisions giving certain former employees, retirees, spouses and dependent children the right to temporarily continue their health coverage at group rates. The employer is required by law to offer the continuation of their group health policy for up to 18 months if there are more than 20 employees.  Since your company is less than 20 employees you would not be required to follow the federal COBRA law.  Some states have a mini Cobra law that requires companies with 2-20 employees to offer a continuation of coverage.  You will want to contact your state department of insurance to find out if your state requires this continuation.  If you are looking for a continuation form, you should contact your insurance company to see if they have a standardized form you should use, or once again, talk to your department of insurance to see if they have one available.
