Q: I was married 10/27. I was terminated 10/31. Initially, I was told I would be covered for both medical and dental under my husband's plan. Then I learned that I am ineligible for dental coverage under his plan. I contacted my former company's benefits in less than 30 days from my termination date requesting my dental coverage be reinstated. I was told that could not be done. In researching your faq’s it appears to me that I should have my cobra dental coverage reinstated as I am well under the 60 day election period you mention. Am I correct? Thank you so much in advance.
A: Under the federal COBRA law you should be able to continue your dental coverage through your previous employer’s group plan as long as you were enrolled in the dental coverage when you were terminated. You should be eligible as long as your previous employer has more than 20 employees on their group health plan in the prior year and they can not be a non for profit organization i.e.: a church. I would contact someone in your human recourses department to ask about the COBRA continuation of coverage. You are correct, you have 60 days from your last day of coverage to sign up for COBRA. If you feel your previous employer is not complying with the federal COBRA law you should contact your state department of insurance or the federal department of labor.
