Q: I live in Florida and my employer is in Maryland. I have worked for this company for ten years and was recently laid off. The HR woman told me "I just spoke with our insurance broker. Under Maryland continuation coverage (similar to COBRA) you must be a Maryland Resident to be eligible for insurance coverage continuation." Is this true? I can't elect COBRA and after 10 years I just have no health insurance and no options under the law?
A: I am guessing that your previous employer does not have more than 20 employees on their group plan which does not make them required to offer the federal COBRA law. The Maryland continuation coverage is a state mini-COBRA law that requires companies with less than 20 employees to offer the continuation of coverage to their employees when they lose insurance. Since all of the state laws are always changing I would suggest contacting the State Department of Insurance in Maryland for more information on your questions.
