Q: Why is COBRA coverage for 18 months not available from an employer in Texas who has less than 20 employees? They are telling me that all I can get is 12 months of coverage under a Texas law.
A: COBRA is a federal law. The way the federal law is set up is that any company with more than 20 employees has to offer the continuation of benefits to their employees when someone loses coverage. Some states do have a mini-COBRA law or a state COBRA law. They usually offer a simular continuation of coverage for companies with 2-19 employees on a group plan.
