Q:  In 1/09 my job cut my hours and I lost my insurance. My husband works for a company that offers insurance. We filled out the insurance company's forms and sent them in. We also decided to elect Cobra because we didn’t want a lapse in coverage. Now the insurance company says that we can not join until open enrollment because we opted to take cobra. Why is that?

 

A:  The reason that you were not able to enroll in the group health plan due to the eligibility rules with your husband’s enrollment process.  Contact his HR department to see what their special enrollment policy is.  Ultimately what happened because you enrolled with Cobra you declined the option with his company.  It sounds that you are only eligible for his plan, if you are not currently covered on another insurance plan.
