Q: I was employed for 5 years at a company, am now on cobra through them (15 months so far). If I go back to work (different company) and get group insurance through them, if I leave the new company (other than for those reasons that make one ineligible for cobra) is there a minimum amount of time I have to work for the new company to be eligible for cobra through them? Secondly, does the amount of time one can be on cobra (normally the 18 months) at all depend on how long you work for a company?
A: Each group plan has eligibility requirements specific to that plan. Once an employee has met their eligibility and has elected the group coverage through their employer, if the employee leaves, they are eligible for 18 months of COBRA. The normal 18 months COBRA eligibility is not prorated based on the number of years employed. The 18 months time frame is part of the law.
