Eligible worker status for student dependents who graduated in December

Q:  Under the new law does a student dependent who has lost coverage under their parents' insurance policy because they have graduated qualify as an eligible worker for the COBRA 65% subsidy? The student graduated on December 15, 2008 and has not been able to find a job.

 

A:  The student would be eligible for Cobra coverage; however I do not believe he would be eligible for the subsidy due to the fact that he was removed from the parents insurance due to graduating school.  To be eligible for the stimulus/reduction the employer who is working and has the group health plan had to have been laid off involuntarily.
