Q: I left my last job March 2008. I began a new job and thought that my old health insurance would continue for a month. I was unaware that they ended my insurance the day I left my job. From March 2008 to April 2008, I went to the doctors a couple of times for test (again thinking I was covered) and ran up $1,000 in medical bills. I have to pay it now. Is there anyway I can go back and pay for Cobra for one month even though over a year has passed? I was eligible for Cobra at the time I left my last job.
A: Normally, the eligibility to elect Cobra is a 60 day window, if it has been over a year than I don’t believe you are going to be able to elect Cobra for that time period and get that covered. To my understanding you are going to be the one responsible for those medical bills. If you feel that your rights are not being met, and that you feel that you should be able to get it covered, you can visit the Department of Labors website, www.dol.gov they are who oversee the Cobra law and you may be able to find some answers on the webpage.
