Q:  My husband sent his initial payment in June and has not yet had coverage (the pharmacy says that he is not active) Now the company said that he has been terminated because they have not received his second payment that was due on 8/3. Is this legal? Can he be reinstated and what recourse do we have? Thank you very much for your input/information.

 

A:  You need to call your past employer or your Cobra administrator the 3rd party handling your Cobra benefits.  They are the ones who are handling your benefits, and call let you know if they haven’t received the payment.  (did the check get cashed) If you feel that your rights are not being met, you can always try contacting the Department of Labor they are the ones who over see the Cobra law you can reach them at  866-444-3272.
