Q: I was laid off on 8/31/2009. The letter stating that I was entitled to COBRA was not sent out until 9/9/2009. That letter had an incorrect monthly rate of $0.00 and it took me several days to get them to give me the correct rate. I mailed in my COBRA Election Agreement and Request for Treatment as an Assistance Eligible Individual on 9/21/2009. It is now 9/28/2009, and the COBRA administrator is telling me that it will be about 2 weeks after they receive my forms before I can get on COBRA. Do you think that they are taking too long?
A: When you lose your job, from the last day you have benefits your employer has 45 days to send you your Cobra paperwork, when you received your paperwork you have 60 days to elect the coverage. When all is said and done your Cobra coverage will go retroactive back to the day you lost your benefits. It sounds like they are still in the window to get the coverage take care of, if you feel however that your rights are not being met you can always contact the Department of Labor, they are the ones who oversee the Cobra law.
