Q: Can an employer deny/refuse to provide COBRA insurance coverage? I was never provided a COBRA package after my dismissal/firing. I had contacted my HR and they have never returned my calls regarding this question. Finally, after one month my former supervisor contacted me and indicated that I do not qualify for COBRA in spite of the fact that I was an active full time participant in their company offered Highmark Insurance Plan. She indicated the Cobra package will not be provided to me.
A: If there is more than 20 employees at the Company and you were on the group health plan, and there is still a group health plan in force, Cobra should be an option to you. Unless, because there was gross misconduct than Cobra wouldn’t be an option. If they say it was gross misconduct they do not have to offer you Cobra coverage. You need to find out why you are not eligible for the coverage, and if you feel that your rights are not being met you can always contact the Department of Labor they oversee the Cobra law. www.dol.gov/COBRA
