Q:  I just found out today (12/7/09) that my former employer is changing insurance companies as of 1/1/2010, and the premiums will be $62 a month more. I haven't even received the formal notification yet; this was when I called to find out when the new bill coupons would be sent out.  Is this legal to change companies? I don't even know if this new plan will cover expenses related to my existing disability!!  Is this extremely short time frame legal? I will have new insurance in less than a month and I don't know what it covers!

A:  As far as if you are on Cobra now, and your Company is changing their group health plan you have the opportunity to change as well.  You would need to speak with the past employer to verify how to go about this. If you elect COBRA coverage, the coverage you are given must be identical to the coverage that is currently available under the plan when you left your position. You will also be entitled, while receiving COBRA coverage, to the same benefits, choices, and services that current employees are receiving. You will also be subject to the same rules and limits that would apply to similarly situated participants.  You can also go to www.dol.gov/COBRA to find more information out about Cobra or you can call the Department of Labor who oversee the law at 866-444-3272.
