Q: I resigned from my employment on 1/6/10 before my employer could terminate my employment. I worked at a Call Center and took a call from a person committing fraud who portrayed himself as an employee of the company I worked for. I removed an alert on an account which allowed this person to commit fraud and the company had a dollar loss. The unemployment office recommended that I resign so that it would not show on my employment record that I was terminated. My husband is on disability and this is the only insurance that we had. Would I still qualify for Cobra and would I be able to get the 65% reduction?
A: You most likely are going to be eligible for Cobra, Cobra is a continuation of the same Insurance you had when you were working. You would need to speak to the HR Department of that past employer and ask them for your Cobra packet and see if you are eligible. As far as the reduction, I do not believe you are going to be able to receive that, the reduction is applicable if you are involuntarily terminated and it sounds to me that you quit. So to my understanding your Cobra will not be subject to the 65% reduction.
