I was layed off, what are my insurance rights?

Q:  I have recently been layed off from my job. I became sick and was hospitalized. Upon my return to work I was given little or no work. After explaining to my employer that I needed to work to keep my insurance I was told that they would understand if I needed to quit. I asked if this was a lay off and was told no. Several weeks later I was layed off and my insurance cancelled. I am still sick. I have been trying to find out what my rights are and have not been able to. Any help in this matter would be greatly appreciated as I am very confused. Thank you in advance for your attention in this matter.

A:  If you are working for a company that has more than 20 employee's than it is a federal law that they will have to offer you a continuation of their group health plan. After you have been terminated from the insurance, the employer has up to 45 days to get information to you regarding your COBRA rights. You will then have 60 days to make your elections and make your first premium payment. Once your payment is made and your insurance is in force your coverage is retroactive and will back date so there is no lapse in coverage. So the medical treatment that may have occurred with in that time period will have to be resubmitted to the insurance company for you to be reimbursed.
