Q: I put in my two week resignation yesterday, Feb. 9, 2010, in which my employer then let me go immediately. Today I requested that they prepare my enrollment/ election form for continued medical coverage with COBRA. They stated that they would do that at their convenience and I do not anticipate much cooperation on their part. What, as an ex-employee, are my rights? Is my medical coverage terminated upon resignation and what amount of time is the employer allowed to get my continued medical coverage?
A: If they Company has more than 20 employees than Cobra is an option to you and they have to get you that information, they do however have 45 days from your last day of benefits to supply it to you. Once you receive that Cobra information, it does go retro-active so there is no lapse in your coverage. If you feel however your rights are not being met, you can call 866-444-3272 or you can visit their website at www.dol.gov/COBRA that is The Department of Labor and they oversee the Cobra laws.
