Q: Hi, I never received my election form to let me know of the last day to sign up for Cobra coverage and pay my premium. What can I do to request an extension to pay my initial payment for continuing my coverage? I have a lot of unpaid medical bills and I'm worried that my insurance won't pay for them once I return to work next week. Your help will be very much appreciated.
A: If your past employer has more than 20 employee's than they are legally responsible for sending you a COBRA notice and an election form in the mail. They have up to 45 days to comply. If you have not received notice, you may want to contact your past employer to request an election form. As soon as you receive that letter and make your elections, you will need to return that along with a premium payment. Once that is received by the employer or the third party administrator, then the insurance policy will be reinstated and your coverage will be retro active. There should be no lapse in coverage. If your employer does not comply with the law they could face fines by the Federal Government.
