Q: I am going to quit my job next month and want to continue our group plan through COBRA. And my wife is due on the following week. I am told from my company that my current health insurance will be terminated as soon as I quit the job and need to wait for several weeks before erecting COBRA. What if my wife delivers our baby before COBRA erection? Because this is baby delivery, its cost is beyond my capability.
A: Your previous employer has up to 45 days from your last day of work or from the last day your group benefits end to send you the COBRA packet. When your election form and payment is received by your previous employer (or their 3rd party administrator) your COBRA coverage is retro-active to your last day of employment or your last day of group benefits. There is no lapse or gap in coverage. You may be required to pay any medical bills that you occur from your last day to the time it takes to process your paperwork. You also should let the doctor and hospital be aware that you are signing up for COBRA and they may make arrangements with you. The insurance company will reimburse you for any claims that you had to pay out of pocket during the time the paperwork gets processed.
