Q:  If an employer has a 90 waiting period before benefits begin, then after that 90 day period you begin to receive benefits, is there a minimum amount of time you must be a part of that benefits plan before you can file for cobra under the employers plan? In other words, if you work for an employer for 6 months, 3 months without benefits and 3 months with benefits could you file for Cobra benefits under their plan?

A:  As long as you have obtained health insurance from your employer you are eligible for the continuation coverage. The length of employment is not a factor for determining eligibility. If your employer has more than 20 employees they are required under COBRA law to provide with COBRA continuation.
