Q: I am a state of RI worker and I have waived my health insurance because my husband is also a State of RI employee. I am 59 yrs old and I am retiring in Dec, 2007. I am covered under my husbands plan and my question is: When my husband retires in February, 2009 he will automatically go onto the Cobra coverage, will I be able to pick up Cobra also at that time? I have been told by Employee Benefits that I will be at the time of my husbands retirement also go on Cobra as a state employee even though I retired in Dec. 2007. Please clarify this all to me. Thank you
A: When you leave your job, even if it is because of early retirement, you and the dependents covered at the time, would be qualifed for a continuation of the group health plan that you were on. You would have the ability to elect COBRA for up to a maximum of 18 months. The medical conditions that you have will be covered under the COBRA law if they were covered by your policy prior to the termination. If you are eligible for Medicare, you will no longer be eligible for COBRA.
