Q: I am going through a divorce. I called my former spouse's employer to ask about COBRA coverage and was told that since I am not a former employee, I am not eligible for this coverage. Is this correct?
A: No, if you are on your husband’s employer’s group health plan before the divorce and they have more than 20 employees you are eligible for COBRA. Your husband’s employer must provide you with the continuation under COBRA law. You will be able to continue the insurance for up to 36 months.
These events apply to covered spouses and the dependants.
1. Death of employee.
2. Divorce or legal separation.
3. Loss of dependant status, or when a child comes off of employees insurance due to age or school status.
4. Employee is entitled to Medicare benefits
If the employer is not being cooperative and does not offer you the COBRA continuation you should contact the US Department of Labor at www.dol.gov
