Q: My husband got a new job; his new employer said that we'd all be on their insurance from hire-date. His hire date is Oct. 1st. his last day with his old employer is Sept. 25th and the insurance terminates the 29th of Sept. so are we going to have to get cobra for like 2 days? Old insurance is First Care, new will be CIGNA. Do I NEED to pay for cobra since we'll have insurance on the 1st of Oct. and that will be way before the old employers 45 days to get us the papers and our 60 days of electing for cobra?
A: The employer does have up to 45 days to mail you the paperwork and you have an additional 60 days to elect COBRA. If you do not elect COBRA continuation the insurance will stop on Sept. 29th and you don’t have to pay. If you should have a claim or medical bill during the two days, then you should elect COBRA when you receive the paperwork and the bills that occurred during this time frame will be paid.
