Q:I sent in my election form for cobra dental insurance to my previous employer several months ago. I didn't include payment and have not made payments as I had become unemployed shortly after electing it and could not afford it. I never heard from them regarding my insurance and assumed they did not reinstate it since I had not paid anything. I just received a letter detailing all the months I had not paid and that they would cancel my insurance if I did not pay which is fine, but am I liable for the back payments?
A: If you don’t make the 1st COBRA payment within 45 days from the date you mailed your election form to the employer or plan administrator, you will lose your COBRA rights.The COBRA continuation never started because you didn’t make any payments.So, this means you are not liable for any back premiums that the employer is asking for you to pay.
