Q: When I left my employer I immediately relocated to start work with my new employer. Since that time I never received information about continuing COBRA. During this time I needed medical attention. My coverage terminated August 31, 2007 with my previous employer and my new coverage started October 1, 2007. Can I pay for Cobra for the month of September 2007? The hospital bill is for September 17, 2007.
A: If your previous employer has more than 20 employees and you were on the group health insurance before you left, you are eligible for COBRA continuation. Your employer is legally responsible for sending you the COBRA packet within 45 days from your last day of work or the last day of your group benefits. If you have not received your paperwork or need a duplicate election you need to contact your previous employer. If you are still in the election period you can sign up for COBRA. The COBRA coverage is retro-active and any medical bills you occur during the election period will be paid by the insurance company based on the benefits you had before you left.
