Q:  The 45 days have lapsed and I have tried to contact my employer HR department, with no response. My wife has a health condition and we are concerned about a lapse in coverage making it difficult to get new coverage. We are running out of time..... What do we do?

A:  If your previous employer has more than 20 employees and you were on the group health insurance before you left, you are eligible for COBRA continuation.  Your employer is legally responsible for sending you the COBRA packet within 45 days from your last day of work or the last day of your group benefits.  If your employer did not send you the election form for COBRA continuation they can be fined by the US Department of Labor (DOL).  You can reach the DOL at 1-866-487-2365.
