Q: The company that I am working for is completely shutting every store in the United States leaving me without a job. Since they are going out of business do they still have to extend the opportunity to get COBRA? The group insurance that I have now covers gastric bypass and I am currently going through the process to have that done. If my company closes before my procedure, will the benefits change under COBRA?

A:  As long as your previous employer keeps the group health policy in force you will be able to continue on COBRA with the same benefits and same coverages as before.  However, if your previous employer cancels or ends their group health plan because they closed the doors, COBRA is not going to be an option for you.
