Q: I would like to know why I was not notified in advance of my sons termination (due to age) before he was terminated. After going to the doctor today, he went to the pharmacy to get his prescriptions filled and was informed at that time that his insurance was terminated. The insurance company said it was in my book (which I don't have), and therefore I didn't realize the time was up. Shouldn't someone have sent me a notice?
A: Your employer should have given you a Summary of Plan Descriptions (SPD) with-in the first 90 days of your employment. This is a written document that includes information about your rights, the group benefits and coverages and how the plan works. If your employer has more than 20 employees then they should have offered your son COBRA continuation. They have up to 45 days to mail the election form the last day he had group benefits. Once you elect COBRA the insurance is retro-active to the last day of group benefits. So, there won’t be any days without coverage. Any medical expenses you pay for will be reimbursed by the insurance company when the COBRA paperwork has been completed.
