Q:My health insurance coverage ended with my previous employer on 07/31/07. My wife needed x-rays in August 2007. I paid the COBRApremium for August. Neither my wife nor I needed health care for September 2007. I did not pay COBRA premiums for September 2007. My new employer has offered me health insurance starting November 1st and offered to pay COBRA premiums for October. With me not paying COBRA premiums for September and being offered the opportunity to have medical coverage, Can I skip a month for COBRA and still have coverage for October as long as 63 days has not elapsed from having a coverage break?
A:COBRA law does not allow you to “skip” months.If your previous employer is willing to reinstate your COBRA continuation coverage then you will be required to pay for both September and October.Because you did not make your September payment when it was due or during the 30 day grace period your previous employer or plan administrator does not have to reinstate your coverage.
