Q:My husband paid into COBRA at his job which had less than 20 employees. He has recently lost his job and does not qualify for COBRA since the company employs less than 20 people. Can he get refunded from the business the money he put into Cobra? And why would a company that employees less than 20 people have COBRA in the first place?
A:COBRA is not a benefit that an employee pays for when he is still employed unless his hours were reduced from full-time to part-time COBRA is a continuation of the employer’s group benefits when the employee leaves the job for any reason other than gross misconduct and the employee must elect COBRA. An employer with less than 20 employees is not subject to COBRA laws and is not obligated to offer the continuation of the group health plan. The money that was deducted from your husband’s paycheck must have been the premiums for the group health insurance you had when he was employed. You should contact his previous employer to confirm this.
