Q:  An ex-employee does not choose COBRA for himself, but his spouse does. The spouse is on COBRA and has a baby. Can she add the baby to her COBRA coverage?

 

A: Yes, COBRA law will allow the ex-employee to add his newborn baby to his COBRA continuation coverage.  The ex-employee or spouse has up to 30 days to notify (from the birth date) the previous employer.  The ex-employee doesn’t have to be enrolled in COBRA to sign-up the baby as long as the spouse or other dependent children have the COBRA continuation.
