Q: My stepdaughter elected NOT to enroll in Cobra, yet she received a bill for thousands of dollars that she apparently "accumulated" over the last year. Throughout this website and other paperwork I have collected, I keep seeing the word ELECT- Was I wrong to instruct her not to respond to the initial COBRA letter? I never would have imagined that failure to respond would have been interpreted as a request for coverage. That is ridiculous! Please help!
A: If the employee is eligible for COBRA the employer must provide the continuation of the group health plan by mailing a COBRA packet to the employee. The election form in this packet will allow the employee to either elect COBRA or decline COBRA. With either choice the form needs to be submitted to the employer or their plan administrator. If your step-daughter does not want the COBRA coverage then she doesn’t have to pay any COBRA premiums.
