Q:I was terminated on the 26th of October. My son was rushed to the hospital 6 days later due to Respiratory problems. My insurance company is refusing to pay the bill, stating that it was after I was terminated. But I thought they have to cover me for at least up to 30days after my termination. I thought this was the law. Am I wrong? And what should I do?
A:The employer is not obligated to continue the group benefits after your last day of work unless you elect and pay for COBRA.
If your previous employer has more than 20 employees they have to offer you COBRA continuation coverage.COBRA coverage is retro-active, it starts on the last day of your group benefits. The COBRA plan administrator has up to 45 days to mail you the COBRA packet from your last day of group benefits.Once you receive the election form, you have 60 days to elect COBRA.Any medical bills that you occur during the election period will be paid by the insurance company when your election form and first payment has been processed based on the benefits you had before the termination
