Q:   I was terminated.  I went to get a prescription filled and the pharmacy said my insurance was cancelled.  Since I was terminated I have had several doctor appointments and I am scheduled for surgery.  I have left messages for my previous employer but they haven’t returned my called. 

 

A:  If your previous employer has more than 20 employees they must offer COBRA continuation coverage unless you were “let go” for gross misconduct.  The previous employer or their plan administrator has up to 45 days from your last day of group benefits to mail you the COBRA packet.  You need to submit the election form to your previous employer or their plan administrator before the election period expires. COBRA coverage is retro-active to your last day of group benefits and you will not have a lapse in coverage.  Any medical bills that you incur during the election period will be paid by the insurance company based on the benefits you had before your termination. If you paid for your prescriptions, hold on to the receipts.  The insurance company will reimburse for any medical bills you paid out of pocket.   If you are eligible for COBRA and your employer is not offering COBRA continuation you should contact the US Department of Labor at 1-866-487-2365.
