Q: My husband’s health plan terminated due to a qualifying event. We received the COBRA continuation letter. I replied and elected to enroll. I have not recieved any correspondence from their Cobra at all. My question is My husband has just been offered a job starting next week - will we still have to pay for any cobra coverage or can we just enroll in the new employers insurance with out any preexisting clauses?
A: If you have a lapse of more than 63 days your new employer’s group health plan can put limitations on pre-existing clauses. If you will be enrolled in your new employer’s group health plan within the 63 days from the termination date of your previous employer’s health plan then you may not have to pay for COBRA. However, if it takes 90 days or more before you can enroll in the new plan, they will put limitations on pre-existing conditions if you have a lapse in coverage. You may want to consider a more affordable COBRA alternative incase an unexpected illness or injuries occurs during the gap between employer’s group health plans.
