Q: I am looking into new employment; there will be a 30 day lapse between my old insurance (through the place of employment I am currently at) and the new insurance (through the new employer). I have had a medical claim in the last 30 days and have been told that I must take COBRA for this reason. Is this true?
A:You can not have more than a 63 day lapse of insurance or your new employer can put limitations on pre-existing conditions. Your previous employer can consider your current medical condition has pre-existing if you go have more than 63 days between your insurance coverage. If you want your recent medical claims to be paid then you need to sign up for COBRA coverage.
