Q: The company that my husband had worked for almost 30 years is closing their doors and moving production to China. My husband's employment was terminated and part of his severance package was that his/our medical insurance coverage would be covered until 12/31/07. I contacted his employer three weeks ago to request the proper forms to file for COBRA coverage. I was told that the forms would be mailed out. Since I had not received the forms, I called yesterday and was told (by the same individual) that we would have to wait until after 12/31/07 when the insurance we now have would be officially terminated before we could file for COBRA insurance. As I have been given wrong information before from this company, I am skeptical. Since my husband and I are both in our early to mid 50's, I really don't like the idea of being without medical coverage for any period of time. Is this the right procedure?
A: Your previous employer or their COBRA plan administrator has up to 45 days from the last day of group benefits to mail you the COBRA packet. Once you elect COBRA the insurance is retro-active so there is no lapse or gap in coverage. You will be reimbursed by the insurance company if you have to pay for any medical bills out of pocket while you are waiting for the paperwork to be processed.
