What do I do if I have a pre-existing condition and my past employer only has 8-10 people employed? What are my options?

Q:  My girlfriend has lost her position as office manager and chose to leave that office. She is going to have an operation on her lower back in about 10 days or so. It is a small office 8 - 10 people. What can she do for coverage? Her operation could keep her off for about 6 weeks with follow-up appointments. Can COBRA help her in any way? Thank you in advance.

A:  If the company has less than 20 employees they are not subject to the federal law and they do not have to offer you a continuation of their group health plan. What you will want to do is contact your state department of insurance to see if there is a state issued mini-COBRA plan that you can take advantage of.
