Q: If you initially declined cobra coverage and are still within the designated time period, can you reverse your decline and start it again? I am on long term disability and had initially declined paying the cobra premium as I qualified for Ohio Medicaid. Effective 3/1/08 my eligibility w/Medicaid has been terminated, which leaves me w/no coverage. Is it possible to pay the monthly premium and get back on the plan that my employer carries?
A: COBRA election does have certain time limitations. You have only 60 days to elect COBRA. That is by the 60th day from when the written notice was sent to you or from when your health care coverage has been terminated, whichever event is later. Your employer has up to 45 days to get the letter to you in the mail stating your COBRA rights.
If you miss the election period date you will lose your rights and will no longer qualify for continuation coverage.
