Q:Can a small business elect to offer COBRA for only 9 months? The employer said that because he is a small business he only has to offer COBA for 9 months.
A:If an employer has more than 20 employees, they must offer continuation of their group health plan for up to 18 months through COBRA.If an employer has less than 20 employees, they are not subject to federal COBRA.You should contact your state’s Department of Insurance at www.naic.orgto see if your employer must follow a state mini-COBRA law.If an employer is not subject to COBRA laws (and their insurance carrier approves) they have the option to provide you with continuation coverage and they can set their own limits to how long you can keep the group benefits.
