How Do I Know If My Business Has To Offer COBRA?

Does my business have to offer COBRA?

Companies With 20 Or More Employees Must Offer COBRA After A Qualifying Event

If you have over 20 employees, you must offer continuation of health insurance benefits when an employee was terminated or another qualifying event happens that would make family members eligible. Employers excluded from offering a continuation of benefits are government employers (they must comply with a similar law), churches or church controlled employers and small business with less than 20 employees.

Some States Have Mini-COBRA

Do your research. Over 40 US States now have Mini-COBRA laws that enforce similar rules to the federal COBRA law, except it’s required for businesses with 19 or fewer employees. Each state handles their Insurance Continuation laws differently.
