Q: I had a question: I resigned from my job on March 24th 2014 i started a new job and insurance doesn’t go into affect until July. my previous employer never sent me a form in regards to COBRA or explained COBRA to eme. to this day i have heard nothing i have a 7 month old baby that was on my insurance and then added to his father, his father also took a new job and resigned from same place and never received cobra forms. What do we do next. My previous employer has no clue what they are doing and you ask questions and get no where.

A: Not all employers are required to offer COBRA. Your previous employer had to have at least 20 employees, have offered health insurance on a group policy, and you had to have left on terms that did not include “gross misconduct” on your part.

If your employer does meet this criteria, then you should have legally received a COBRA packet.

If your previous employer cannot answer your questions or does not comply, you can call the Department of Labor at 1-866-487-2365.
