My Texas Employer Says I’m Not Eligible For COBRA. What Do I Do?

I was terminated and my employer said I’m not eligible for COBRA. I live in Texas. Besides finding my own insurance, is there anything I can do?

First, you will need to understand what makes you eligible for COBRA.

Eligibility Requirements For COBRA Insurance

  • Your previous employer must have 20 or more employees
  • You must have had the benefit of a group health plan through your employer.
  • Your termination must not have been for “gross misconduct.”

If all of these conditions apply, you should speak with your previous employer again. If your previous employer can not answer your questions or does not comply, you can call the Department of Labor at 1-866-487-2365.
