Q: I am dealing with am employee who has just given birth. I understand that an employee will receive all vacation and sick days and then go onto disability benefit for 6-8 weeks under which time she and her baby will be covered by the employer’s irrespective of whether she eventually returns to work. During the 6-8 weeks we will collect from the employee her part of the insurance before she left to give birth. Is it then after that period of 6-8 week she can apply to Cobra or an alternative? Also is it the case that if an employee is employed by a minimum of time -say even one month or even a week and he is insured under a group plan he is entitled to claim Cobra.
