Q: My mother is over 65 years old, but she is still working full time, she will need to go out on disability – will she be able to get COBRA coverage? A: At the age of 65 she is entitled to Medicare. Being entitled for Medicare is a qualifying event. Meaning, if you are coming off the employer’s group health plan because you are entitled to elect Medicare, your dependants have the right to elect COBRA coverage for up to 36 months. If you are coming off of your COBRA insurance because of the entitlement to Medicare, which would also be a second qualifying event, the beneficiaries could elect COBRA for 36 months from the date you were taken off. Even if she is disabled, COBRA would not be an option for her because of the entitlement to Medicare, only her beneficiaries and or dependents can continue on the employers group health plan.
