Q: Can my dependent have both COBRA coverage and coverage with a different group health plan?
A: Yes. Only if the new employer’s group health plan has a pre-existing exclusion. (meaning that your pre-existing conditions are not covered for a certian time period under the new policy) According to HIPPA laws, a pre-existing condition limitation generally can not be any longer than 12 months. Once the limitations are relieved then COBRA should be terminated.
