Delayed notice to employer of divorce

Between the time that he and his ex-wife signed the divorce papers and when he received the decree, she had emergency surgery and made the claim against his medical insurance. He failed to notify his employer within 60 days of receipt of the decree. Is she not eligible to be covered under COBRA? Who will be responsible for paying for the surgery?
