Former Employer Not Sending Paperwork, Is That COBRA Fraud?

I was laid off. My employer refuses to give me the correct information regarding my COBRA, but continues asking for payment. I need to know to WHOM I send my COBRA check to. I requested the COBRA information packet, I asked a series of questions as far as the COBRA coverage specifics and I asked who the COBRA representative is, and I asked for a direct line to that person. I have emailed and called my HR Rep, but do not get detailed and accurate answers. The company I worked for is in a financial bind and I have doubt as to if I am ACTUALLY paying them for COBRA or if my money is going elsewhere. I have received NO COBRA information or paper work BACK from this employer.

COBRA is not an insurance company. That is why there is no direct phone number to COBRA. Your employer legally has up to 45 days to get to you the information you need to elect COBRA. Your employer may have a third party administrator taking care of that COBRA information, so you may want to ask who their COBRA administrator is that you can contact. If your previous employer can not answer your questions or does not comply, you can call the Department of Labor at 1-866-487-2365.
