How Long Does My Employer Have To Give Me COBRA Info?

I was let go from my job, 16 calendar days ago and still have not received any COBRA paperwork. The insurance amount was taken out of my last check, even though I do not need/want the insurance. How long does the company have to get this information to me? Should they have taken the insurance out without asking me?

Your employer legally has up to 45 days to give you the information to elect COBRA after you were laid of from your job. Because you signed up for that health care plan with your employer, you would need to speak with them about a refund of your insurance premium and when your coverage ends.

Companies that do not send the COBRA election form paperwork will pay penalties and be fined by the US Department of Labor.
